These terms are an agreement between you and us. Section 15 says disputes are settled by individual arbitration rather than in court, and you can opt out of that within 30 days.
We are not a real estate agent or broker, and we do not buy houses. HomeSick is a lead generation service. We pass your details to an independent cash buyer, and that buyer pays us. You never pay us anything.
We cannot promise you an offer, and cash offers are normally below full market value.
Section 15 requires disputes to go to individual arbitration and waives class actions and jury trials. You may opt out within 30 days.
These Terms are an agreement between you and Birdseye Sourcing, trading as HomeSick Property Solutions (“HomeSick”, “we”, “us”), covering homesickpropertysolutions.com, every form and quiz we run, and the communications that follow.
By using the site, or by submitting your information through any form on it, you agree to these Terms and to our Privacy Policy, which forms part of them. If you do not agree, do not use the site.
You must be at least 18, resident in the United States, and asking about property located in the United States. You must either own the property or have legal authority to sell it — for example as an executor, trustee, attorney-in-fact, or a co-owner with the other owners' agreement. You must also be the person who uses the phone number you give us, or have that person's permission to give it.
We run a lead generation service. We collect information from homeowners who may want to sell, and we pass it to a third party who buys property or markets related services. That third party pays us.
To be completely clear about what we are not:
The service is free to you. We never charge you a fee or a commission. If anyone claiming to be HomeSick asks you for money, it is not us — contact us straight away.
You confirm that everything you tell us is true and complete, that you meet the requirements in section 2, and that you have the right to give us the phone number and email address you provide. You are responsible for the accuracy of what you submit. Giving us false information, or someone else's details without their permission, is a breach of these Terms.
By submitting your information you give your prior express written consent to receive marketing and informational calls, text messages and emails from HomeSick and from the buyer and partners we pass your details to, at the number and email address you provide, including a mobile number, including calls and texts made with automated dialling systems and prerecorded or artificial voices, and even if your number is on a federal, state or company do-not-call list. Your consent is not a condition of any purchase and is not required in order to receive an offer on your property.
Message frequency varies, and message and data rates may apply. Calls may be recorded for quality and compliance where the law permits.
You can withdraw consent at any time: reply STOP to any text, use the unsubscribe link in any email, tell a caller to put you on their do-not-call list, or contact us under section 19. Withdrawing consent with us does not automatically stop a buyer who already has your details, so you may need to tell them as well. Full detail is in our Privacy Policy.
You agree that we sell and share the information you submit, that we are paid for it, and that we are paid whether or not you ever receive an offer or sell your property. We sell each enquiry to one buyer. You grant us a perpetual, worldwide, royalty-free licence to use, store, transfer, sell and license that information for these purposes, subject to your right to opt out of future sales as described in our Privacy Policy.
We do not guarantee that you will be contacted, that you will receive an offer, that any offer will match any figure shown on this site, that it will be in cash or free of conditions, that it will close in any particular time, or that a buyer will not reduce or withdraw it after an inspection.
Cash offers are normally below full retail market value, because the buyer takes the property as it is, covers costs you would otherwise pay, and carries the risk of reselling it. Any figure, table or comparison on this site is illustrative. Any review or testimonial is one person's experience and is not typical or guaranteed.
Every buyer, investor, agent and service provider we pass your details to is an independent third party. They are not our employees, agents or partners, and we do not control them. We do not endorse, vet, guarantee or verify any buyer, their funding, their licensing or their conduct.
Any agreement you reach is between you and that buyer. We are not a party to it and have no liability for it. Be aware that some buyers are wholesalers who intend to assign their contract to another buyer at a profit rather than close themselves. This is common and legal in most states, but you should read any contract carefully and consider having a lawyer look at it — particularly if a buyer asks you for money up front, pressures you to sign immediately, asks you to sign a deed rather than a purchase contract, or offers to take over your mortgage payments.
Everything on this site is general information only. It is not legal, tax, financial or real estate advice and is no substitute for advice from a licensed professional in your state. Laws, timelines and homeowner protections vary considerably from state to state. Nothing here creates a lawyer-client, fiduciary or advisory relationship.
The site and everything on it — text, graphics, the HomeSick name and logo, design and layout — belongs to us or our licensors. You may use the site for your own personal purpose of enquiring about selling your property. You may not copy, reproduce, distribute or reuse it otherwise, or use our name or logo without our written permission.
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ANY INFORMATION OR ESTIMATE ON IT IS ACCURATE, OR THAT YOU WILL RECEIVE ANY OFFER. WE MAKE NO WARRANTY OF ANY KIND ABOUT ANY BUYER OR ANY CONTRACT YOU ENTER INTO WITH ONE.
TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR OFFICERS, EMPLOYEES OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, OR LOST PROPERTY VALUE OR EQUITY, ARISING OUT OF THE SITE, YOUR SUBMISSION, ANY COMMUNICATION YOU RECEIVE, OR ANY DEALING WITH ANY BUYER.
OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU HAVE PAID US (NORMALLY ZERO) OR ONE HUNDRED US DOLLARS ($100).
Some states do not allow certain exclusions, so parts of sections 12 and 13 may not apply to you. Nothing here excludes liability that cannot lawfully be excluded.
You agree to cover our losses, costs and reasonable legal fees arising from your use of the site, from any information you submit (including any phone number you were not entitled to give us), from your breach of these Terms or of any law, and from any dispute between you and a buyer.
PLEASE READ THIS SECTION. IT AFFECTS HOW DISPUTES ARE RESOLVED AND LIMITS YOUR RIGHTS TO GO TO COURT.
15.1 Talk to us first. Before starting any formal process, send us a written notice describing the problem and what you want, to [email protected]. We will try in good faith for 60 days to sort it out.
15.2 Arbitration. If that fails, any dispute arising out of the site, these Terms, our Privacy Policy, your submission, or any communication you received from us or from a buyer we passed your details to — including claims under the Telephone Consumer Protection Act and state telemarketing or privacy laws — will be resolved by final and binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, before one arbitrator. The Federal Arbitration Act governs this section. Arbitration will take place in the county where you live, or by phone, video or on documents if you prefer.
15.3 Who it covers. This arbitration agreement also covers, and may be relied on by, our suppliers and the buyer and partners we pass your information to, for claims arising out of your submission or the communications that followed it. They are intended beneficiaries of this section.
15.4 No class actions.
YOU AND WE EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT COMBINE MORE THAN ONE PERSON'S CLAIMS. YOU AND WE ALSO WAIVE THE RIGHT TO A JURY TRIAL.
15.5 Fees. Arbitration fees are allocated under the AAA Consumer Rules. Where those rules would make you pay more than a court filing fee would have cost, we will cover the difference, unless the arbitrator finds your claim was frivolous.
15.6 You can opt out. You may reject this arbitration agreement by writing to [email protected] within 30 days of first submitting your information, giving your name, the phone number and property address you submitted, and a clear statement that you are opting out of arbitration. Nothing else in these Terms changes, and we will not treat you any differently.
15.7 Exceptions. Either of us may still bring an individual claim in small claims court, or go to court to protect intellectual property or stop unauthorised access to the site. Nothing here stops you reporting a matter to a government agency.
15.8 Governing law. These Terms are governed by the law of the State of Wyoming and applicable US federal law. For any dispute not covered by arbitration, the state and federal courts of Laramie County, Wyoming have exclusive jurisdiction. This does not take away the protection of the consumer laws of the state where you live.
You agree to deal with us electronically. Clicking a button, ticking a box or submitting a form on this site is your electronic signature and has the same effect as signing on paper, under the federal E-SIGN Act. You agree we may send you these Terms, our Privacy Policy, consent disclosures and other notices by email or by posting them on the site. You can ask for a paper copy, or withdraw this consent, by contacting us — though we would then no longer be able to provide the service.
We may change these Terms. The new version applies from the moment it is posted and we will update the date at the top. If a change is significant we will say so on the site. Continuing to use the site means you accept it. Changes to section 15 do not apply to a dispute we already knew about.
A postal address for legal notices is available on request by email.
